  • Continued Site Plan Review Associated with a Special Use Permit - Change in Tenancy from General Office to Local Retail (Halal Market) - 1648-1652 Western Avenue - Hiam Corporation

    The site plan was last reviewed at the Planning Board's January 10, 2024 meeting.  The site plans have been updated to show 20 parking spaces can be accommodated on the site.  The applicant is proposing a change in tenancy within an existing 4,988 square feet building to a local retail business (Halal market) on 0.73 acres of land located in the Local Business LB) District. 

    1. Site Plan Review Associated with a Special Use Permit - 97-99 Twenty West Drive Mixed Use Building - Dr. Karamdeep Singh

      The applicant is proposing a 2 1/2 story mixed use building on 1.82 acres located in the Local Business (LB) District.  The first floor will consist of commercial tenant space.  The second and third floors will consist of 7 multi-family units on each floor, for a total of 14 multi-family units. A Special Use Permit was previously approved (SUP 08-21) on this site in November 2021 by the Zoning Board of Appeals for a mixed use building, but the applicant never pursued constructing the building. That special use permit has since expired.

      1. Concept Plan Review for a 2 Lot Minor Subdivision - 2155 West Old State Road - Matthew T. Beliveau

        The applicant is proposing a 2 lot subdivision of 91.68 acres +/- of land located in the RA3 District.  Lot 1 would consist of 65.68 acres of land and Lot 2 would consist of 26 acres of land.  Both lots would be accessed from West Old State Road.  The application was be referred to the Town of Princetown and Town of Rotterdam considering the north property line abuts the two town boundaries.  The application was referred to the Albany County Planning Board for their February meeting.

        1. Concept Plan Review for a 3 Lot Minor Subdivision - 200-300 Aaron Lane - William W. Wright

          The applicant is proposing a 3 lot subdivision on 4.06 acres of land located in the Single-family (R20) District. Lot 1 would consist of 1.09 acres and contains a pre-existing single-family dwelling and accessory structure; Lot 2 would consist of 1.15 acres; and Lot 3 would consist of 2.24 acres.  Public water and sewer is provided to Lot 1 and will be provided to Lot 2.  Lot 3 will have a private well and septic system, which will need approval from the Albany County Department of Health.

        • State Farm Road/Nott Road. Concept Plan Review for a 4-Lot Cluster Subdivision - (Tax ID# 51.00-2-5.8) - JRG Builders, LLC. The applicant is proposing a 4-lot cluster subdivision on 35.2 acres +/- of land located in the RA3 District.  All four lots are proposed to be accessed from Stare Farm Road (NYS Route 155).
           

        • 3407 Carman Road - Donald F. Cropsey, Jr. Project Update Site Plan Review for a Residential Facility, Independent Living Development - The applicant is proposing a 12-unit residential facility, independent living development on 1 acre of land located in the Local Business (LB) District.  The development will consist of 3 buildings with 4-units in each building.

        • Concept Plan Review for a 2 Lot Minor Subdivision - Grant Hill Road - Emery & Patricia Lemieux. The applicant is proposing a 2 lot subdivision of 80.5 acres of land (Tax ID# 61. 00-2-12.1) located in the RA3 District. Lot 1 would consist of 1.9 acres and would be located on the west side of Grant Hill Road. Lot 2 would consist of 78.51 acres and would be located on the east side of Grant Hill Road. An area variance for lot size reduction would be required on Lot 1.
           
        • Site Plan Review Associated with a Special Use Permit - Change in Tenancy from Local Retail to Cannabis Dispensary - 1666 Western Avenue - Stage One Allstars, LLC The applicant is proposing to operate a retail cannabis dispensary within an existing 2,496 square feet building on 0.38 acres of land located in the Local Business (LB) District.
           
        • Site Plan Review Associated with a Special Use Permit - Change in Tenancy from General Office to Local Retail - 1648-1652 Western Avenue - Hiam Corporation The applicant is proposing a change in tenancy within an existing 4,988 square feet building to a local retail business (meat market) on 0.73 acres of land located in the Local Business LB) District.
           
        • Site Plan Review Associated with a Special Use Permit - Medical Office (Cancer Treatment Center) - 4 Crossgates Mall Road - Columbia Development Companies The applicant is proposing a 120,000 square feet medical office building (New York Oncology Hematology Cancer Treatment Center) on 8.36 acres of land located in the Transit Oriented Development District.

        • Site Plan Review Associated with a Special Use Permit for a Cold Storage Building - 5640 Depot Road - S&L Roofing. The applicant is proposing to construct a 40' x 40' cold storage building on 12.5 acres of land located in the Industrial District.  No electricity or running water will be provided to the building.  The purpose of constructing the building is to store equipment associated with the roofing business. There are two existing warehouse buildings on the property previously approved by Special Use Permits.
           

        • Site Plan Review for a Residential Facility, Independent Living Development - 3407 Carman Road - Donald F. Cropsey, Jr. The applicant is proposing a 12-unit residential facility, independent living development on 1 acre of land located in the Local Business (LB) District.  The development will consist of 3 buildings with 4-units in each building.

        • Preliminary Concept Plan Review - Altamont Hills 10 Lot Major Subdivision - 6067 Gardner Road - Stefan Marikovics

          The applicant is proposing a 10 lot major subdivision on 96 acres of land located in the Rural Agricultural (RA3) District.  Lot sizes range in size from 4 acres to 33 acres, with an average lot size of 9 acres.  The applicant is requesting a preliminary review of their concept plan layout.  Considering no public water or sewer is available in this area of town, the applicant would like the Planning Board to review the proposed lot layout and receive feedback prior to conducting soils tests, perc tests, etc. on each lot to determine feasibility of private wells and septic systems on each lot.
           

        • 61-65 Schoolhouse Road - 4 Duplex Dwellings - Schoolhouse Luxury Townhomes, LLC

          The applicant is proposing 4 duplex dwellings on 0.76 acres of land located (2.97 acres common area of development) in the Multiple-Residence (MR) District. The proposed application is an extension of the previously approved 8 duplex dwellings.  A private lane (Dexter Lane) provides vehicular access through the existing development and will be extended to provide access to the proposed dwellings. The existing 3 single-family residences at 61-65 Schoolhouse Road will be demolished as part of the development of the site.

        • Site Plan Review Associated with a Special Use Permit for a Change in Tenancy - United Fitness, Sports & Pools, Inc. - 1650 Western Ave

          The applicant is proposing to change the use within an existing commercial building from an office use to a shopping center use on 0.73 acres located in the Local Business (LB) District.  Proposed exterior changes to the site include the removal of grass/bushes in a portion of the front of the building and trees that are close to the building and the rear of the building for additional parking and to limit branches from damaging the building.  The building currently has two lease spaces and the applicant indicates the space could be leased for one or two tenants.
           

        • Site Plan Review Associated with an Amendment to a Special Use Permit to Allow a Retail Cannabis Dispensary within an Existing Medical Cannabis Dispensary - 10 Executive Park Drive (Stuyvesant Plaza) - PharmaCann of New York, Inc.

          PharmaCann of New York, Inc. d/b/a Verilife currently operates a medical cannabis dispensary at this location.  The applicant is proposing to amend their existing Special Use Permit to allow a retail cannabis use in addition to the medical cannabis use.
           

        • Site Plan Review Associated with a Special Use Permit for a Change in Tenancy - REI CO-OP Retail Store - 1 Crossgates Mall Road - Crossgates Mall General Company Newco, LLC

          The applicant is proposing to remodel approximately 25,155 square feet within the existing Forever 21 retail space to be an REI CO-OP retail store.
           

        • Town Board Referral for an Amended Change in Zone Application from a Single-Family (R15) District to a Local Business (LB) District - 1854 Western Avenue - Chris Laviano

          The Planning Board had previously reviewed a referral from the Town Board at your May 24, 2023 and September 13, 2023 meetings for a proposed change in zone on 0.45 acres.  The applicant submitted an amended Change in Zone application now requesting a change in zone on 1.14 acres.  The additional acreage included in the amended request includes two single-family lots approved as part of a minor subdivision in October 2022.

        • PUBLIC HEARING. Possible Consideration of Final Plat Approval for a 2 Lot Minor Subdivision - 5601 Grant Hill Road - John Noppa and Carolyn Jonientz

          The applicant is proposing a 2 lot minor subdivision on 8.09 acres of land located in the Rural Agricultural (RA3) District.  Lot 1 would consist of 3.6 acres and Lot 2 would consist of 4.5 acres.  Concept plan approval was issued at the Board's January 25, 2023 meeting.  The Board issued a SEQR negative declaration at the March 8, 2023 meeting.
           

        • Consideration of Final Plat Approval for a 2 Lot Minor Subdivision - 493 Church Road - Joseph Stanco

          Concept Plan approval for the minor subdivision was granted at the June 23, 2021 Planning Board meeting. The applicant is proposing a 2 lot subdivision of 9.07 acres +/- of land located in the Residential Overlay (RO40) District.  Lot 1 would consist of 2.19 acres and Lot 2 would consist of 6.9 acres.  Both lots would be accessed from Church Road.
           

        • Site Plan Review Associated with a Special Use Permit for an Existing Office Conversion to an Apartment - 1840 Western Avenue - Deborah Hoelzli

          The applicant is proposing to convert an existing office use (formerly used as an apartment) on the 2nd floor to a 2 bedroom apartment on 0.2 acres in the BNRP District.  No exterior changes to the site or building are proposed.  The site shares driveway access from Western Avenue with 1842 Western Avenue.
           

        • Town Board Referral for an Amended Change in Zone Application from a Single-Family (R15) District to a Local Business (LB) District - 1854 Western Avenue - Chris Laviano

          Consideration of Issuing a SEQR Negative Declaration and Possible Consideration of Site Plan Approval for Site Improvements and Building Facade Alterations. The applicant is proposing an office use within an existing 2,781 square feet building on 0.62 acres located in the Local Business (LB) District. The plans have been updated since the July 12th meeting, with revisions including landscaping at the rear of the parcel.
        • PUBLIC HEARING. Settles Hill Road/Furbeck Road - Michael Flocuzzio. Consideration of Issuing a SEQR Negative Declaration and Consideration of Final Plat Approval for a 3 Lot Minor Subdivision. The applicant is proposing a 3 lot minor subdivision of 15.31 acres of land located in the Rural Agricultural (RA5) District. The plans have been updated since the June 14th meeting. Lot 1 consists of 5.1 acres; Lot 2 consists of 5.1 acres and Lot 3 consists of 4.92 acres. An area variance for lot size is required for Lot 3, with a variance application having been submitted to the Zoning Board of Appeals. All lots will be on private wells and septic systems that will require approval from the Albany County Department of Health. At their July 19, 2023 meeting the Zoning Board of Appeals granted an area variance (Variance No. 4957) for Lot 3, allowing a 4.92 acre lot size where 5 acres is the minimum in the RA5 District.
        • 6283 Farm Lane - Ecolegacy Values, LLC.
          Referral from the Town Board - SEQR Coordinated Review for a Change in Zone of 35 acres +/- from a 128.4 acre parcel, from the Residential Overlay (RO40) District to a Rural Agricultural (RA3) District. The parcel totals 128.4 +/- acres and is located immediately east of the Western Turnpike Golf Course and west of Foundry Road. The applicant is proposing to rezone 34.86 acres to the RA3 District, with 94.12 acres remaining in the RO40 District. Surrounding zoning consists of properties located in the Residential Overlay (RO) District to the west; Residential Overlay (RO) District and Single-family Residential (R15 and R20) Districts to the east; Single-family Residential (R15) District to the north; and Rural Agricultural (RA3) District to the south.
