  • PUBLIC HEARING. Consideration of Issuing Final Plat Approval for a 3 Lot Minor Subdivision - 200-300 Aaron Lane - William W. Wright

    The applicant is proposing a 3-lot subdivision on 4.06 acres of land located in the Single-family (R20) District. Lot 1 would consist of 0.822 acres and contains a pre-existing single-family dwelling and accessory structure; Lot 2 would consist of 0.759 acres; and Lot 3 would consist of 2.355 acres.  Public water and sewer are provided to Lot 1 and will be provided to Lot 2 and Lot 3.
     

  • PUBLIC HEARING. Consideration of Issuing Final Plat Approval for a 4 Lot Cluster Subdivision - State Farm Road/Nott Road (Tax ID# 51.00-2-5.8) - JRG Builders, LLC

    The applicant is proposing a 4-lot cluster subdivision on 35.2 acres +/- of land located in the RA3 District.  All four lots are proposed to be accessed from Stare Farm Road (NYS Route 155).  Lot 1 would would consist of 52,409 square feet; Lot 2 would consist of 57,996 square feet; Lot 3 would consist of 32,208 square feet; and Lot 4 would consist of 36,708 square feet.  The applicant is proposing to convey 9.35 acres to an abutting property owner and would be deed restricted open space and 20.48 acres to the Town of Guilderland, which would be incorporated as part of Nott Road Town Park.

  • 1758 Western Avenue - Consideration of Site Plan Approval - Salon (Change in Tenancy) - Patricia Brockley. The applicant is proposing a salon within an existing building on 0.67 acres of land located in the Local Business (LB) District.
     

  • 1828-1830 Western Avenue - Site Plan Review to Amend a Previously Required Condition of Approval - Westpalm, LLC & Lauren France. The applicants are jointly submitting their site plan applications requesting to amend a condition of approval from a 1995 Special Use Permit.
     

  • 3434 Carman Road - Site Plan Review Associated with a Special Use Permit - Matthew DiGesare

    The applicant is proposing to amend a 1987 special use permit approval for the following: (1) remove an existing single-family dwelling at 7149 Fuller Station Road; (2) install a 2,400 square foot addition to an existing 4,000 square feet building, which will extend into the 7149 Fuller Station Road parcel; (3) remove an existing stockade fence and install a 6' high chain link fence; (4) install 4' high Norway Spruce along a portion of the south property line and (5) expand an existing stormwater management facility by approximately 3,000 square feet.

    The applicant is proposing a 2 lot minor subdivision of 128.98 acres of land located in the Rural Agricultural (RA3) District and RO40 District. Lot 1 would consist of 68.55 acres and is in the RA3 District.
     

  • Consideration of Issuing a SEQR Negative Declaration for a 4 Lot Cluster Subdivision - State Farm Road/Nott Road (Tax ID# 51.00-2-5.8) - JRG Builders, LLC

    The applicant is proposing a Local Shopping Center within an existing 14,744 square feet building (former Westlawn Lanes Bowling) on 1.5 acres of land located in a dual zone district; Local Business (LB) and Single-family (R15) District. The application was last reviewed by the Planning Board at the March 8, 2024 meeting.

  • Concept Plan Review for a 2 Lot Subdivision - 2 Marian Court - Stacey Zyskowski. The applicant is proposing a 2 -lot subdivision of 3.2 acres of land located in the R20 District.  Lot 1 will consist of 1.07 acres and contains a single-family dwelling and accessory structures.  Lot 2 will consist of 2.2 acres and is undeveloped land.  Public water and sewer is available.  The application has been referred to the Albany County Planning Board and Village of Altamont.
     

  • Site Plan Review Associated with a Special Use Permit for a Fast Food Restaurant - 1666 Western Avenue - Z&Z Real Estate, Inc.. The applicant is proposing to renovate the existing 2,400 square feet building and convert the use to a fast food restaurant with dine in and take out deliveries on 0.38 acres located in the Local Business (LB) District.
     

  • Site Plan Review Associated with a Special Use Permit - Medical Office (Cancer Treatment Center) - 4 Crossgates Mall Road - Columbia Development Companies

    The applicant is proposing a 120,000 square feet medical office building (New York Oncology Hematology Cancer Treatment Center) on 8.36 acres of land located in the Transit Oriented Development District.
     

  • Sketch Plan Review for the Foundry Square Planned Unit Development - 2308-2312 Western Avenue - Guilderland Village, LLC. At their May 7, 2024 meeting the Town Board accepted the Foundry Square Planned Unit Development (PUD) Application. The applicant is proposing a mixed use development consisting of 285 units in two 4-story buildings and 10,000 square feet of commercial space in one of the buildings.  The applicant is proposing a minimum of 10% of the units (29 units) to be 'workforce housing' units. One of the buildings on the property, former Master Cleaners dry cleaning business, is a NYS Department of Environmental Conservation (DEC) designated brownfield site.

  • Consideration of Site Plan Approval for an Office Conversion to Daycare Center (Curious Minds Daycare) - 1873 Western Avenue - Saood Rafique. The applicant is proposing to convert office space to a daycare center within a portion of an existing 28,462 square feet building located on 2.7 acres in the Local Business (LB) District.  The proposed use is considered a SEQR Type 2 action, therefore, is exempt from SEQR.
     

  • Concept Plan Review for a 3 Lot Subdivision - 6051 State Farm Road - Hiawatha Land Development, LLC. The applicant is proposing a 3 lot subdivision on 19.2 acres of land located in the R40 District associated with the previously approved Special Use Permit for a 256 unit residential facility, independent living development (Hamilton Parc).  The applicant is proposing separate lots for Phase I and Phase II of the development for financing purposes. Lot 1 will consist of 9.41 acres and contains Phase I of the development and approximately 130 units.  Lot 2 will consist of 6.64 acres and will be Phase II of the development.  Lot 3 will consist of 3.18 acres of land the applicant is proposing to convey to the town for town park purposes and will be incorporated with the 24.5 acres located to the west, which is also proposed to be conveyed to the town and will become a new town park named Kaikout Kill Park totaling 27.7 acres.
     

  • Concept Plan Review for a 4 Lot Subdivision - 6270 Johnston Road Rear (The 1700 PUD) - 1700 South, LLC. The applicant is proposing a 4 lot subdivision on 25.9 acres of land located in a Planned Unit Development (PUD).  Lot 1 will consist of 4.55 acres and contains 2 3-story multi-family unit buildings.  Lot 2 will consist of 0.71 acres.  Lot 3 will consist of 6.88 acres.  Lot 4 will consist of 9.21 acres.  The PUD was approved in February 2015 and allowed for the construction of 9 multi-family buildings, mixed use office/retail building and club house.  The purpose of the subdivision is to create multiple parcels for financing purposes.
     

  • Site Plan Review Associated with a Special Use Permit for an Office Conversion to Shopping Center - United Fitness, Sports & Pools, Inc. - 1650 Western Ave. The applicant is proposing to change the use within an existing commercial building from an office use to a shopping center use on 0.73 acres located in the Local Business (LB) District.   The application was last reviewed by the Planning Board at your October 25, 2023 meeting.  Since that meeting another applicant proposed a halal market at this site, which the Zoning Board denied.  The previous applicant has updated the site plan and is proceeding with the former shopping center use.
     

  • Site Plan Review Associated with a Special Use Permit for a Self Storage Facility - 2360 Western Ave - A Metro Movers. The applicant is proposing to construct a climate control and cold storage self storage facility consisting of one 10,000 square feet, 2-story climate control building and 3 cold storage buildings totaling 17,000 square feet on 3 acres in the Local Business (LB) District. The existing hotel use and single-family residence will be demolished as part of the proposed development.  
     

  • Review of Proposed Local Law No. 4 of 2024 - 6 Month Moratorium on Certain Residential Development. The Town Board is considering enacting a 6 month moratorium on certain residential development and has requested comments from the Planning Board on the proposed Local Law.

  • Public Hearing. Consideration of Issuing a SEQR Negative Declaration and Consideration of Final Plat Approval for a 2 Lot Minor Subdivision - 2155 West Old State Road - Matthew T. Beliveau

    The Planning Board issued concept plan approval at your February 14, 2024 meeting.  The applicant is proposing a 2 lot subdivision of 91.68 acres +/- of land located in the RA3 District.  Lot 1 would consist of 65.68 acres of land and Lot 2 would consist of 26 acres of land.  Both lots would be accessed from West Old State Road.
     

  • Site Plan Review for an Office Conversion to Daycare Center (Curious Minds Daycare) - 1873 Western Avenue - Saood Rafique

    The applicant is proposing to convert office space to a daycare center within a portion of an existing 28,462 square feet building located on 2.7 acres in the Local Business (LB) District.
     

  • Concept Plan Review - Barth Meadows 42 Lot Cluster Subdivision - NYS Route 146/Concord Hill Drive/Posson Road - BM Guilderland, LLC

    The Barth Meadows Subdivision project area consists of 4 parcels with tax map identification numbers of 39.00-3-34, 39.00-3-35, 39.00-3-36 and 39.00-2-28. Their respective, approximate acreages are 17.02, 3.10, 33.16 and 33.69 acres for a total project site area of approximately 86.97 acres. The project proposes a residential cluster subdivision with 42 single family homes.  

    In September 2022 the applicant presented a concept plan of 70 lots to the Development Planning Committee.  In February 2023 the applicant presented a concept plan to the Planning Board proposing 66 lots.  The Planning Board did not support the density, tabled the application and requested the applicant reduce the number of lots. The applicant is now proposing 42 lots.
     

  • Consideration of Issuing a SEQR Negative Declaration for a 12 Unit Residential Facility, Independent Living Development - 3407 Carman Road - Donald F. Cropsey, Jr.

    The applicant is proposing a 12-unit residential facility, independent living development on 1 acre of land located in the Local Business (LB) District.  The development will consist of 3 buildings with 4-units in each building.
     

  • Site Plan Review Associated with a Special Use Permit - 97-99 Twenty West Drive Mixed Use Building - Dr. Karamdeep Singh

    The applicant is proposing a 25,000 square feet,  2 1/2 story mixed use building on 1.82 acres located in the Local Business (LB) District.  The first floor will consist of commercial tenant space.  The second and third floors will consist of 6 multi-family units on each floor, for a total of 12 multi-family units. The application was last reviewed at the Board's February 14, 2024 meeting where the applicant was proposing a 34,000 square feet building with 14 apartments. A Special Use Permit was previously approved (SUP 08-21) on this site in November 2021 by the Zoning Board of Appeals for a mixed use building, but the applicant never pursued constructing the building. That special use permit has since expired.

  • Concept Plan Review - 3 Lot Minor Subdivision - 4478 Western Turnpike - Michael Floccuzio. The applicant is proposing a 3 lot subdivision of 10.7 acres of land located in the RA3 District.  Lot 1 would consist of 3.23 acres; Lot 2 would consist of 3.74 acres and Lot 3 would consist of 3.74 acres.  Public water is available to the site.  Private septic systems will be required. A historical family cemetery is located on proposed Lot 3. A 10' wide access easement is proposed on Lot 3 to provide access to the cemetery.  An area variance from Section 280-30.C of Town Code will be required to be approved by the Zoning Board of Appeals to allow structures within the 500' setback from the Watervliet Reservoir high water mark.  The application was referred to the City of Watervliet for review and comment.
     

  • Site Plan Review Associated with a Special Use Permit (Local Shopping Center) - 1975 Western Ave - RL Penna, LLC.   • Referral from Town Board - Review of Draft Local Law No. 3 of 2024 Regulating Short-Term Rentals. The Town Board is considering amending Chapter 280 of the Town Code by adding Subsection AA in Section 240 (Supplemental Regulations) adopting guidelines for short-term rentals (rentals less than 30 days).  The Town Board is requesting the Planning Board review the local law and provide comments.
