At this Zoning Board of Appeals meeting there are as of this posting 5 new cases and 6 signs to be reviewed as well as 3 other issues, one of which is to consider extending the Hiawatha Trails project for 1 year.

  • Of the new cases,
    • The developer of the apartments on Vosburgh Road, across from the Hannaford, is requesting a variance from Town Sprinkler Code for the club house.  The Developer is asking to install sprinklers of lower capacity will be installed with foam installation to avoid installing a lager water main to eh building which was not contemplated in the project design and budget.
    • The 6580 Dunnsville Road variance for a portion of a solar array in a required side setback is of great interest to GCRG. There will be a Public Hearing at this meeting regarding this project. THIS PUBLIC HEARING IS FOR THE SIDE SETBACK VARIANCE ONLY.  THE PLANNING BOARD WILL NOT CONDUCT A SITE PLAN REVIEW WITHOUT THE GRANTING OF THIS VARIANCE.
  • Of the signs to be reviewed, one of the 6 to be reviewed is for a new monument and building mounted signs for the Sunmark bank being built next to the new car wash at 2115 Western Ave.

  • Included in other business, at the every end of the agenda, is a request to extend the Special Use Permit for the Hiawatha Trails Extension. The ZBA Agenda indicates that the owner is requesting an extension to the Hiawatha Trails Special Use Permit for one year. Yet the letter attached to the Agenda indicates the request is 2 years from May 15, 2021 until May 15, 2023.

Some of this meeting agenda for the Zoning Board of Appeals was originally set for the October 7th Zoning Board meeting.  Due to inclement weather the meeting was postponed and all cases were rescheduled for October 21st.

At this Zoning Board of Appeals meeting there are as of this posting 3 new cases and 1 sign to be reviewed. None appear to be of great importance to the GCRG, although you may like to know that owner of the the new and extremely over illuminated Knockout Car Wash being built at 2123 Western Avenue is seeking a Special Use Permit Amendment to build an outside stairwell in the back to reach the office on the upper level.

At this Zoning Board of Appeals meeting there are 2 continued cases, 3 new cases and 2 signs to be reviewed. Of importance to the GCRG are the following:

  • 2501 & 2505 Western Avenue - decision only on the Store Away variances (Governor's Inn).
  • 1769 Western Ave. Colonial Car Wash seeks variance for larger sign to match competitor.
  • Sign review for Mill Hill Town Homes and the Stewart's Car Wash on New Karner Road.

The agenda for this meeting of Guilderland Zoning Board of Appeals lists one continued case and two new agenda items. 

  1. 2501-2505 Western Ave - proposed Store Away Storage Facility
    This is a continued case and the applicant seeks:
    1. An area variance from installing sprinklers in the storage units as required by Town Code § 239-3 New buildings required to have sprinkler systems because the individual storage buildings do not meet the qualifications of New York State Code.
    2. An area variance from installing sidewalks in front of the proposed storage facility as required by Town Code § 227-2 Required sidewalk locations which clearly states that sidewalks shall be installed along both sides of state road like Route 20.
  2. 2965 W. Old State Rd. Independent Living Residential Facility proposed by Serafini Builders
  3. 3068 Furbeck Rd, Christmas Land is now seeking an extension to their originally approved hours and to allow large decorations to remain all year round where originally they were required to be removed by the last day of February the subsequent year after.

The review of Signs is listed as an agenda item as well, but there is no additional information on what signs are to be reviewed. 

There is also an agenda item listed as "Others" with no additional information about that either.

The agenda and meeting documents can be found with the link on this page on the town’s website.  There are 2 cases to be continued one of which is the sign variance request for McDonalds at 1602 Western Ave.  There are 4 new cases to be considered which do not appear to be significant. 

The McDonalds sign variance request is a continuation from June 3, 2020,  where they were asking for 6 signs totaling 196 square ft where 2 signs of 50 square ft is permitted. One sign to be placed within 2 ft from property line in the front where there is a 20 ft setback requirement.
