  • PUBLIC HEARING. Consideration of Final Plat Approval for a 2 Lot Minor Subdivision - 2272 W Old State Rd - Michael J Della Rocco III

    The Planning Board issued concept plan approval the March 12, 2025 Board meeting and issued a SEQR negative declaration at the May 14, 2025 Board meeting.  The Applicant is proposing a 2 lot subdivision of 41 acres of land located in the RA3 District.  Lot 1 would consist of 3 acres of land and Lot 2 would consist of 38 acres of land and contains an existing single-family dwelling, barns and garage.
     

  • Happy Days Dispensary (Retail Cannabis Dispensary) - 1656 Western Avenue - Yesorno, LLC

    Continued site plan review from the June 11, 2025 Board meeting. The applicant is proposing to renovate the existing building (formerly Side Door Cafe and Press Beauty Studio) for a retail cannabis dispensary on 0.42 acres located in the Local Business (LB) District.  Exterior building and parking lot improvements are proposed.
     

  • Town Board Referral of a Change in Zone of a 3.1 Acre Parcel from a Business Non-Retail Professional (BNRP) District to Local Business (LB) District - 2093 Western Avenue - Jennifer McClaine
     

  • Town Board Referral of a Change in Zone of a 0.31 Acre Parcel from a Business Non-Retail Professional (BNRP) District to Local Business (LB) District - 1859 Western Avenue - Laviano Properties, LLC
     

  • Site Plan Review Associated with a Special Use Permit - Home Occupation II - 5700 Depot Rd - NY Pro Services, LLC

    The applicant is proposing to operate a small lawn maintenance company from his residence on 1.86 acres located in the Industrial District.
     

  • Sketch Plan Review Associated with an Affordable/Workforce Housing Planned Unit Development (PUD) - 6 & 10 Mercy Care Lane - Rockabill development, LLC

    At their June 3, 2025 meeting the Town Board authorized an exception from the current moratorium on certain residential development to allow this PUD application to proceed.  The applicant is proposing to construct an affordable/workforce housing project consisting of 72 units on 10.71 acres of land.  Approximately 80% of the development units will be reserved for affordable households with AMIs at 30% to 60%; the remaining approximately 20% will be reserved as workforce housing at 80% AMI. These AMI tiers will target households with annual incomes ranging from approximately $30,000 - $90,000.

  • Concept Plan Review for a 4 Lot Subdivision - 6270 Johnston Road Rear (The 1700 PUD) - 1700 South, LLC

    The application was last before the Planning Board at the April 10, 2024 meeting, where the Board tabled the concept plan review.  The applicant is proposing a 4 lot subdivision on 25.9 acres of land located in a Planned Unit Development (PUD).  Lot 1 will consist of 4.55 acres and contains 2 3-story multi-family unit buildings.  Lot 2 will consist of 0.71 acres.  Lot 3 will consist of 6.88 acres.  Lot 4 will consist of 9.21 acres.  The PUD was approved in February 2015 and allowed for the construction of 9 multi-family buildings, mixed use office/retail building and club house.  The purpose of the subdivision is to create multiple parcels for financing purposes.
     

  • Home Occupation I (Hair and Nail Salon) - 29 W Dillenbeck Dr. - Lindsay Markou

    The applicant is requesting to renovate the existing ground floor in a single-family dwelling for a hair and nail salon on 0.42 acres of land located in the R10 District.  The applicant is requesting to construct two stations to provide hair and nail services.  The business will be operated by a mother and daughter and no outside providers will be coming to the house. The salon will have a separate access and entrance.

  • Consideration of Preliminary Subdivision Approval - Barth Meadows 42 Lot Cluster Subdivision - NYS Route 146/Concord Hill Drive/Posson Road - BM Guilderland, LLC
    The Barth Meadows Subdivision project area consists of 4 parcels with tax map identification numbers of 39.00-3-34, 39.00-3-35, 39.00-3-36 and 39.00-2-28 and a portion of 39.00-3-37. The total project site area of the proposed subdivision is approximately 87 acres. The applicant proposes a residential cluster subdivision of 42 single-family lots, with 6 lots proposed on Posson Road and 36 lots proposed on Azalea Lane, new Town Road, which will connect Concord Hill Drive to NYS Route 146.  The Planning Board issued a SEQR negative declaration at the December 11, 2024 meeting.
     

  • Site Plan Review Associated with a Special Use Permit (Curious Minds Daycare) - 1859 Western Ave - Namra Khan.
    The applicant is proposing an early childhood education center within a portion of an existing 8,000 square feet mixed-use building located on 0.96 acres of land in the Local Business (LB) District.
     

  • Site Plan Review Associated with a Special Use Permit (Beauty Salon) - 1834 Western Ave - Brett Yorio.
    The applicant is proposing to convert an existing finished garage space within a single-family dwelling to a beauty salon on 0.19 acres in the BNRP District. The salon will have one employee and all services will be by appointment only.
     

  • Concept Plan Review for a 3 Lot Minor Subdivision - Shady Acres Drive/Shady Crest Court - Dale Houck.
    The applicant is proposing a 3 lot subdivision of 7.3 acres of land located in the RO30 District.  Lot 1 will consist of 3.56 acres.  Lot 2 will consist of 1.44 acres.  Lot 3 will consist of 2.31 acres.  The parcel is located in the Albany Pine Bush Preserve Management Area and is recommended for partial protection.
     

  • Concept Plan Review for a 2 Lot Minor Subdivision - 4304 Frederick Road - Ben Radtke.
    The applicant is proposing a 2 lot subdivision of 55.8 acres of land located in the RA3 District.  Lot 1 will consist of 6.28 acres and contains an existing 60' x 100' one-story steel garage.  Lot 2 will consist of 48.82 acres of land and is undeveloped.
     

  • Concept Plan Review for a 4 Lot Minor Subdivision - 50 Hanley Ln - Eddie Salisbury Jr. The applicant is proposing a 4 lot subdivision of 8 acres of land located in the RO40 District.  Lot 1 will consist of 4.5 acres and contains an existing single-family home and accessory buildings.  Lot 2 will consist of 0.93 acres, Lot 3 will consist of 1.77 acres and Lot 4 will consist of 1.12 acres.
