  • PUBLIC HEARING - Consideration of Issuing a SEQR Negative Declaration and Consideration of Final Plat Approval for a Two Lot Minor Subdivision - 4117 Western Turnpike - Paul Mueller The applicant is proposing a 2 lot minor subdivision of 64.4 acres of land located in the Rural Agricultural (RA3) District. Lot 1 would consist of 61.4 acres and is undeveloped land. Lot 2 would consist of 3 acres and contains an existing single-family residence with detached garage. The applicant is proposing a keyhole lot to access Lot 1 and would require a shared access/maintenance agreement between Lot 1 and Lot 2. An area variance would be required on Lot 2 as the design of the keyhole lot would further reduce the side setback to 27 feet where 50 feet is required.
     
  • PUBLIC HEARING - Consideration of Issuing a SEQR Negative Declaration and Consideration of Final Plat Approval for a Two Lot Minor Subdivision - 3397 Carman Road - Gabe August The applicant is proposing a 2 lot minor subdivision of 0.87 acres of land located in the Local Business (LB) District. Lot 1 would consist of 12,983 sq. ft. +/- and contains an existing single-family residence with accessory buildings; and Lot 2 would consist of 22,523 sq. ft. +/- and contains a duplex. The applicant is also requesting two area variances, as follows: (1) allow a reduction in minimum lot size on Lot 1 to 12,983 sq. ft. where 20,000 sq. ft. is required; and (2) allow a reduction in lot width on Lot 1 to 77 feet where 100 feet is required. The variances were approved by the Zoning Board of Appeals at their August 4, 2021 meeting.

  • PUBLIC HEARING and Consideration of Final Plat Approval for a Proposed 2-Lot Minor Subdivision at 15 Dutch Hill Terrace - Anthony P. Hazapis The applicant is proposing a two lot subdivision on 2.1 acres +/- of land located in the Single-family Residential (R20) District. Lot 15 would consist of 1.09 acres +/- and contains an existing single-family dwelling. Lot 15A would consist of 1.01 acres +/- and is currently undeveloped. A grading plan was prepared for proposed Lot 15A, which indicates 0.6 acres of trees on the site would be cleared to allow a dwelling to be constructed.
     
  • Concept Plan Review for a 3 Lot Minor Subdivision - 6185 Johnston Road - Eric Yucai Li The applicant is proposing a 3 Lot Minor Subdivision of 2.2 acres located in the R15 District. Lot 1 will consist of 0.57 acres and contains an existing residential dwelling with accessory structures that will be removed as part of the subdivision. Lot 2 will consist of 0.9 acres and is undeveloped land. Lot 3 will consist of 0.74 acres and is undeveloped land. All three lots will be accessed from Johnston Road and will utilize a shared driveway.
     
  • Borrego Solar - 5MW Ground Mounted Solar Facility - Site Plan Review for a Special Use Permit - 2819 & 2825 Curry Road. The applicant is proposing to install a 5MW ground mounted solar facility on a parcel located in the Agricultural (AGR) District on 47.9 acres +/- of land. The existing conditions of the parcel include agricultural fields and forested areas. A lot line amendment is also proposed, incorporating a 9.4 acre +/- parcel abutting to the west and located in the Single-family Residential (R40) District into the parcel with the proposed solar facility. The new lot will consist of 57.3 acres +/- of land and will be a dual-zoned parcel consisting of AGR and R40 Districts. No portion of the solar facility will be located within the R40 portion of the parcel.
     
  • Site Plan Review Associated with a Special Use Permit for a Storage and Distribution Facility within the Northeast Industrial Park - Airgas - 2 Van Buren Blvd. Airgas is proposing a storage and distribution facility, which will include storage/distribution tanks for argon and nitrogen, which will be serviced by the existing CSX rail line. The facility will also include the use of an existing building within the Northeast Industrial Park for a 2-bay truck garage, offices, restrooms and other accessory uses.

  • Referral from the Town Board - Consider adopting amendments to Local Law No. 7 of 2017 for the Pine Bush Senior Living PUD located at 24 New Karner Road
    The applicant is proposing to replace 96 independent senior housing units with 86 mixed-income affordable senior housing units financed under the State's NY Homes and Community Renewal program. The question before the Planning Board is whether the proposed changes should be considered an amendment to the original application or whether the change truly constitutes the need for a new application. 

    The Planning Board assumed lead agency for the 2017 PUD review/approval, therefore, will assume lead agency for the proposed PUD amendment. Pursuant to 280-17(E)(7) the Town Board has referred the proposed PUD amendment to the Planning Board for a report and recommendation prior to the Town Board consideration of amendments to Local law No. 7 of 2017.     This seems odd to us since the Town Board has not yet finished their own public hearing on this and we think it’s really the Town Board’s decision to make. 

    There was a continuance of a Public Hearing for this application scheduled for the August 3rd meeting of the Town Board. That meeting was cancelled by the Supervisor and we can only assume that the continuance will take place at the next meeting of the Town Board on August 17th. Oddly, that Public Hearing will take place after the Planning Board has made its decision on August 11th.
  • DECISION ONLY - Consideration of a Request for a 90-Day Extension of Time on the Preliminary Plat Approval for a 62 Lot (58 Residential/4 open Space) Cluster Subdivision 2745 West Old State Road -- JTR Realty, LLC
    The Planning Board granted preliminary plat approval for the subdivision at the February 24, 2021 Planning Board meeting. Pursuant to §247-14(H)(2) of Town Subdivision regulations the developer must submit a proposed final plat within 180 days of obtaining preliminary plat approval. The applicant is requesting a 90-day extension for submitting a final plat.
     
  • Consideration of Amending the 2001 Eugene Napierski Final Plat and Consideration of Concept Plan Approval/Issuance of a SEQR Negative Declaration for a Proposed 2-Lot Minor Subdivision at 15 Dutch Hill Terrace - Anthony P. Hazapis
    A two-lot minor subdivision application was submitted for a property at 15 Dutch Mill Terrace on 2.10 acres in the R20 District. The parcel is located within a previously approved 4-lot subdivision in 2001. As part of the 2001 subdivision the Planning Board imposed a condition of final plat approval that prohibited any further subdivision of lots. Prior to the Planning Board issuing concept plan approval of the proposed 2-lot minor subdivision the Planning Board will need to determine whether they will support or oppose removing the plat note from the 2001 subdivision, which prohibits further subdivision of lots.

As of 07/01/21 all Town meetings will be in-person meetings held at the Town Hall with no restrictions regarding COVID 19. The Town administration has yet to announce whether or not town residents will be able to call in to meetings with comments.
