- Referral from the Town Board - Consider adopting amendments to Local Law No. 7 of 2017 for the Pine Bush Senior Living PUD located at 24 New Karner Road
The applicant is proposing to replace 96 independent senior housing units with 86 mixed-income affordable senior housing units financed under the State's NY Homes and Community Renewal program. The question before the Planning Board is whether the proposed changes should be considered an amendment to the original application or whether the change truly constitutes the need for a new application.
The Planning Board assumed lead agency for the 2017 PUD review/approval, therefore, will assume lead agency for the proposed PUD amendment. Pursuant to 280-17(E)(7) the Town Board has referred the proposed PUD amendment to the Planning Board for a report and recommendation prior to the Town Board consideration of amendments to Local law No. 7 of 2017. This seems odd to us since the Town Board has not yet finished their own public hearing on this and we think it’s really the Town Board’s decision to make.
There was a continuance of a Public Hearing for this application scheduled for the August 3rd meeting of the Town Board. That meeting was cancelled by the Supervisor and we can only assume that the continuance will take place at the next meeting of the Town Board on August 17th. Oddly, that Public Hearing will take place after the Planning Board has made its decision on August 11th. - DECISION ONLY - Consideration of a Request for a 90-Day Extension of Time on the Preliminary Plat Approval for a 62 Lot (58 Residential/4 open Space) Cluster Subdivision 2745 West Old State Road -- JTR Realty, LLC
The Planning Board granted preliminary plat approval for the subdivision at the February 24, 2021 Planning Board meeting. Pursuant to §247-14(H)(2) of Town Subdivision regulations the developer must submit a proposed final plat within 180 days of obtaining preliminary plat approval. The applicant is requesting a 90-day extension for submitting a final plat.
- Consideration of Amending the 2001 Eugene Napierski Final Plat and Consideration of Concept Plan Approval/Issuance of a SEQR Negative Declaration for a Proposed 2-Lot Minor Subdivision at 15 Dutch Hill Terrace - Anthony P. Hazapis
A two-lot minor subdivision application was submitted for a property at 15 Dutch Mill Terrace on 2.10 acres in the R20 District. The parcel is located within a previously approved 4-lot subdivision in 2001. As part of the 2001 subdivision the Planning Board imposed a condition of final plat approval that prohibited any further subdivision of lots. Prior to the Planning Board issuing concept plan approval of the proposed 2-lot minor subdivision the Planning Board will need to determine whether they will support or oppose removing the plat note from the 2001 subdivision, which prohibits further subdivision of lots.
- Single Lot Exemption Associated with a Lot Line Amendment - 5820/5838 Ostrander Road - Charles M. Carrow & Julieann Diamond
The applicants are requesting a single lot exemption pursuant to §280-11(F) of Town Code, and lot line adjustment, merging 0.9444 acres +/- from 5838 Ostrander Road with 5820 Ostrander Road. 5838 Ostrander Road currently consists of 3.0 acres of land located in the Rural Agricultural (RA3) District and contains an existing single-family dwelling. 5820 Ostrander Road currently consists of 49.9 acres of land located in the Rural Agricultural (RA3) District and consists of forested areas, fields and an accessory building.
- Site Plan Review for a Special Use Permit - 2.375MW Ground Mounted Solar Facility - 2 Van Buren Blvd (Northeast Industrial Park) - Yellow 5, LLC
Referral from the Zoning Board of Appeals for a site plan review associated with a Special Use Permit to construct a 2.375MW ground mounted solar facility on 15 acres +/- of land located in the Industrial District.
As of 07/01/21 all Town meetings will be in-person meetings held at the Town Hall with no restrictions regarding COVID 19. The Town administration has yet to announce whether or not town residents will be able to call in to meetings with comments.
